Nonprofit Law FAQs

What is the difference between a nonprofit and a not-for-profit?
Under New York law, ‘not-for-profit’ refers to corporations organized without profit-sharing purpose. ‘Nonprofit’ is a broader term. Most charitable organizations in New York are Type B or Type C not-for-profit corporations.
How long does it take to get 501(c)(3) status?
The IRS typically processes Form 1023 within 3–6 months for straightforward applications. Complex applications or those requiring additional information can take longer. Form 1023-EZ (for smaller organizations) is often processed faster.
Can a nonprofit pay its employees?
Yes. Nonprofits can and should pay reasonable compensation to staff and officers. The prohibition is on distributing profits to members or shareholders, not on paying fair wages.
What are the annual filing requirements?
Most nonprofits must file IRS Form 990 annually, register with the New York Charities Bureau, and maintain proper board records. We help you stay compliant.
