How Mediation
Works

Mediation is a structured but flexible process. Here is what you can expect when you engage Maiaklovsky Law Firm as your mediator.

Initial Consultation

We meet with all parties (jointly or separately) to explain the mediation process, answer questions, and confirm that mediation is appropriate for your dispute.

Agreement to Mediate

All parties sign a mediation agreement confirming participation is voluntary and discussions are confidential.

Opening Session

Each party has the opportunity to present their perspective on the dispute without interruption. The mediator listens and identifies common ground and key issues.

Private Caucuses (if needed)

The mediator may meet separately with each party to explore interests, reality-test positions, and identify potential solutions.

Negotiation & Problem-Solving

The mediator facilitates structured negotiation — moving parties toward realistic solutions that address the core interests of both sides.

Agreement Drafting

When parties reach consensus, the mediator prepares a written mediated settlement agreement capturing all terms clearly and enforceably.

Mediation FAQs

Is mediation binding?
Mediation itself is not binding — but once parties sign a written settlement agreement, that agreement is a binding contract. For family matters, it can be submitted to the court for a binding order.
What if we cannot reach an agreement?
Participation is voluntary and either party may withdraw at any time. If mediation does not resolve the dispute, you retain all rights to pursue litigation. Nothing said in mediation can be used against you in court.
Is mediation confidential?
Yes. Mediation sessions and all communications made during mediation are confidential. This encourages frank, productive conversations that would not be possible in court.
Do I need a lawyer for mediation?
You are not required to have your own attorney during mediation, but you may bring one. Many parties consult with their own attorney before and after sessions. As mediator, Attorney Maiaklovsky represents neither party.
How long does mediation take?
Simple disputes may resolve in one or two sessions of 2–3 hours each. More complex matters may require several sessions over a few weeks. Mediation is almost always faster than litigation.
Can you mediate in French or Haitian Creole?
Yes. We conduct mediation sessions in English, French, and Haitian Creole — ensuring all parties can participate fully in the language they are most comfortable with.
